Hyderabad: Sindh High Court (SHC) has taken notice of the fact that allottees of Gulistan-e-Sarmast on an application, a news source reported. SHC issued notices to Municipal Secretary Sindh, HDA governing body, HDA Director General, P& D Director, and Deputy Director Land Management and asked for their replies. The hearing was adjourned to 15th January.
The application was made by Gulistan-e-Sarmast allottees Farhan Abbassi, Abdul Manan Abbasi, Arsalan Abbasi and Nauman Abbasi through their counsel Muhammad Dilawar Qureshi. The application maintains that HDA governing body had announced Gulistan-e-Sarmast Housing Scheme in Latifabad in September 2008 during its 108th meeting.
HDA also made 50% payment to the Board of Revenue, however, the board transferred around 500 acres of land to Gulistan-e-Sarmast. The scheme began in 2009 on a 3-year monthly instalment plan which was to be completed in 2012 and the scheme offered 33,096 plots of sizes varying between 120 sq. yd. to 400 sq. yd. 31,661 plots were booked through balloting.
The applicants booked four 120 sq. yd. plots in Sector 4. Three of the applicants have already paid all the due amount, while the fourth has also paid the majority of the dues. Just PKR 57,560 remains to be paid.
Despite complete payments, HDA has been unable provide physical possession of the scheme to any of the allottees, because not much development work has been completed in the project.
The petition requests that all the three petitioners should be handed over the physical possession of their plots and HDA should be ordered to complete the infrastructure development within three months. The petition also requested that until the court decides on the petition, the plot of petitioner number 4 who is yet to pay the full amount should not be cancelled.
