Karachi: The Sindh High Court on Friday has announced its judgement stating that Scheme 36 – spanning 2,000 acres – is the property of the Karachi Development Authority and any claims about the said land by provincial government or individuals except allotees are not authorized, according to news sources.

The court directed the official authorities to make sure that no encroachments – in form of goths or adverse ownership claims – are placed on Scheme 36. The judgement was issued by a two-judge bench comprising Justice Irfan Saadat Khan and Justice Muhammad Faisal Kamal Alam.

The bench also directed the authorities to retrieve the amenity plots in Scheme-36, block 10, Gulistan-e-Jauhar as per the masterplan and original layouts and instructed KDA to not allow misuse of the same. It also stated that the previous judegements have already declared that the entire land of Scheme-36 belongs to KDA.
These statements were issued by the bench while it disposed of petitions filed in 2014 and 2016, where provincial authroties and individuals tried to file falsified claims on the said property. The court imposed a fine of PKR 100,000 on the second petitioner for abusing the court process by filing multiple litigations for the same issues already determined through the judicial process.
The court ordered the SHC registrar to file a report about the proposed starategy to curb frivolous litigations in four weeks.
