Karachi: The Supreme Court (SC) recently declared the allotment of two acres of land near the city’s Aladin Park to be illegal, a news source reported. To this effect, the apex court cancelled the documents of transfer, lease, and allotment.

A three-judge SC bench, headed by Chief Justice Gulzar Ahmed, issued the directive on a case pertaining to the encroachment of amenity plots. The bench observed that the SC was empowered under Article 184(3) of the constitution to declare those actions of public functionaries unlawful and void ab initio that were under the violation of power and law the functionaries were required to perform under.

They further stated that the same article allowed the apex court to cancel the documents of transaction, lease, selling, or transfer of property.
The court directed the Karachi commissioner to submit a detailed report regarding such allotments. Similarly, the court issued a notice to the builder of Comm-3 building located in Benazir Park to appear before the court with all necessary documents.

The court observed that the building was apparently built on an amenity plot. Additionally, the court ordered the attorney general to remove the illegal structures from the government land in P & T Colony and restore the status of the land.
