Lahore High Court has declared that luxury tax on houses cannot be recovered if it is against the basic rights. Court has demanded answers from the Government and Department of Excise and Taxation, regarding the petition against the implementation of luxury tax on houses.
Yesterday, Advocate Azhar Siddique, while challenging the section 10 of Finance Act 2013, presented his case before Jutice Nasir Saeed Sheikh. The advocate was of the opinion that constitutionally Punjab Government cannot impose luxury taxes. It is against the basics of article 9, 24,23,18,14 and 25.
Tax was imposed on residential properties. However, the properties over 2-kanal and commercial areas were neglected for luxury tax.
