An IHC judge issued a short order dismissing multiple petitions submitted by faculty members and the administration against the scheme. The court declared the project legal since it had obtained the necessary land use approval from the relevant authorities. The CDA council informed the court that the authority had already obtained an Environment Impact Assessment (EIA) of the project from the Pakistan Environment Protection Agency (EPA), which had deemed the project safe for the environment. The CDA council maintained that the project had already been approved and was due to be completed next year.

The court was told that the 5-kilometre-long project was part of the CDA master plan to ease traffic in the area, which was contributing to environmental degradation due to frequent traffic jams. As per the Project Concept-1 (PC-1) submitted by the CDA, the 5-kilometre-long road, including a 1-kilometre-long flyover, would start from Murree Road near the QAU stop and culminate on Murree Road near the Jugi bus stop. The project would be completed by the National Logistics Cell (NLC) within three months.
