Aoa, i have a query i am living overseas can i sell my property without visiting pakistan
Wsalam:
- You can buy (mostly in societies) that have transfer letters instead of registry while being out of PAK.
- You would need to have a Power of Attorney (Mukhtaar Nama) made in the name of person who can sell it off on your behalf, whether outside or in PAK. For Overseas:
-- Getting Power of Attorney document filled (prescribed form available with embassies with nominal fee)
-- Stamped Signed/Processed by that Embassy in whatever country
-- Sent to Pak by individual
-- Getting that Attested by Foreign Office Pak
Other forumers can add, if there could be some other way around!
Walaikam asalam,
Yes, you can do this as I have done this previously:-
You will need to give power of attorney to a trusted person and I would make it a specific power of attorney that has property address details on the power of attorney so you are only authrosing actions that relate to selling of this property. I think giving a general power of attorney where the person can do anything in your name in Pak is a big risk but the decision is yours. I would recommend you use a lawyver that has previously drafted POA's that have succesfully been used in Pakistan for selling proerties since the language of the POA is quite critical.
You will need to get the power of attorney attested by the Pak embassy in your country of residence.
You need to send this POA via a trusted route to the person in Pak.
The person in Pak will need to get it attested at the foreign office in Islamabad.
If you are selling your property for e.g in Rawalpindi the person will need to get is registered in Rawalpindi Katcheri
and pay the necessary property taxes.
- After the property has been registered the local person get fard etc.
I hope this helps and good luck.
Walaikam asalam,
I posted a reply but this was not posted by Zameen.com for some reason. Imtiaz sahib has summed it up pretty well. The only thing I would like to add to this is that after getting it attested by Pak Foreign office you will need to get is registered also in at your local katcheri and paynecessary POA charges e.g I had to get it registered at Rawalpindi Katcheri. Also I would advise you be carefull if you wish to give a general POA or a specific POA that only authorises the sale of this one property.
Good Luck
Thank you Rauf sb for pointing the missing point and adding the registration bit that I missed out of my listed points.
Thank you brother Imtiaz and Rauf khan much appreciated!!!
The above reply to this thread was posted 5 days ago but for some reason Zameen.com posted it yesterday!. I hope this does not confuise things brother Shahzad Ahmed.
