What is the legal status if the buyer asks for more amount than the one he has agreed in the sales agreement. The sales agreement is going to expire shortly and he insists that transfer would only be done if we pay more amount as the property prices have increased in last two months.
Dear Bilal,
Seller can't claim more if stamp paper for agreement of sale between seller and buyer.
Can you share the area where prices have increased in last two months?I think this is dealer drama so be careful before done this deal or homework before final deal.
Regards
If the agreement date expires (which was 3 months from 10% payment ), would same price still be valid. Can seller asks for more if the agreed date in sales agreement expires. Regards, Bilal
Nadeem bhai is right the seller cannot ask for anything more or less than what has been stated in the agreement and i am sure you must have put in a clause to protect yourself in the event of a breach of contract. For example if he backs off from the deal he will pay a penalty or double bayana (if you have given him any) or a clause to force him to sell the plot or house only.
If sales agreement date has expired it depends upon the terms of the agreement you entered into, how it has been drafted. The time may have expired but not his commitment to sell so the agreement still has value.
if the agreement says that he may change value of property after 3 months on prevailing rates then he is in a strong position, otherwise drag him to court because he is just getting greedy
Dont give that stupid a single extra penny…Ask for your dealer to get involved…If he keep on insisting the same, you should make him cancel the deal and ask for double the bayana.
I am grateful to your inputs. It would enable to handle the situation better. Mr.Nadeem Ahmed, Mr.Arshad and Mr.Saadi thank you for your support.
