I need help with the following questions. I request to give me point wise answers as i am new in property, i am expat(living in dubai) and trapped in problematic people.
1. We have passed the above three months. The date for transfer of house has passed. Now, house owne revealed that he has lost his property registry documents. He attached photocopy of the documents with affidavit of bayanah previously.
He advised that we can give brine to cleric and get fard on photocopy also. This way we can proveed further for transfer of property. What could be possible future problems in adopting this way? May be he gien took loan from some person and given his the documents and later it creates problems for us? Please help with the answer. If possible can you kindly give me your calling number for discussion. I am in uae now and i will come pk soon. Your help will be returned whenver possible for me.
2. The second problem is with house possession. He given the house to some one on reant for three years written agreement. The family is not leaving the house as they have written agreement. The owner is proposing us to take possession of one storey and let that family live in the other storey. What could be the possible future problems for adopting this path..
3. The situation seem getting worse fo the above two reasons. It seem that i would have to move to court. I have written affidavit that says that either owner will give two times of money or give house within three months. Three months passed anf looking at the problems, i feel that he cant give even in next six months.How much expense it might cost me to move to court?
4. What court will do possibly? Can court stop sales of house to another person?
5.How much time the court might possibly take to decide?
6.How court force some house owner to follow his written agreement?
7. Do court has authority to get the house transfer if the owner dont agree?
8. As i am out of pakistan and my father is very old to fight case. I can pay one visit for three days a month(including weekend). Is this enough to face court issues.
9. I live in ol city(ravi road). Can you please recommend some good laywer?
Please advise and answer my all questions above. The situation is getting worse and the owner is just fooling us as he feels we cant do anything and he can jsut hae our money with him as long as he wants.
Very sad to hear. It is a typical problem with non-DHA properties and non-DHA residents.
Try involving some influential people of Mohallah to pressurize him and get the deal reverted by getting paid amount back. I think you would not be able to get double amount despite written agreement, so do not pursue it that way.
Other way could be that you should move in the upper storey and rent should go to you straight away. If you can afford this challenge and fight then it then this is the first step you need to take before taking him to the court.

The seller is suspicious person.As he told us that he has lost his registry which is only two year old document, we got more suspicious...we wants to cover our self from any future trouble.
As per patwari record there is no court or bank liability on house ...
Q1: what could the possible reasons for him saying that he lost his registry ? ( like he might handed over to some individual and taken loan )
Q2: possible precautionary measures ? He will get attested copy from kachehry and proceed for fard etc ..but how we cover our self from some future problem

Give give someone an inch and they'll take a mile is a popular quote meaning someone who has been given a small amount of power or freedom to do something, and then has tried to get a lot more.
I would suggest take one portion and get the rent. If e.g. 2 years are pending for the tenants of the agreement persuade them to empty the house in 6 months which they might not take the option and you get it negotiated at 1 year. This way your problem will solve.
Regarding the document i would suggest ask him to bribe or do whatever get it transferred to your name. And threaten him that you will go to court but keep it to just threatening and may be involve some police/nazim with locals help if things don't improve. But dont go to court it will complicate the case. There is a reason property problems cases in court are called "deeewani muqadmaat" because they just never end.
I know you are worried and i have been there but think with your head and solve it with patience.

I visited Paksitan and personally met and convinced the tenant to empty the house in next three months.
I will ask the owner to get FIR of lost documents, give me original FIR for my record, get attested copy of registry from Tehsil and then proceed for transfer.
Any further suggestion will be welcome..
What could be the negative outcomeS(risks) for transfering the hosue on my name and paying the 80 percent of money now. Rest 20 percent after few months when the tenant leave the hosue and we get the possession of house?
