My file lost by the bank

Hello,
I took a loan on my house from hbl. Last month i paid off the loan but i was told by the bank that they have lost my original file which has old registry, leases a, b. They recovered the file partially with my original cbc and meo mutation and my registry. The bank filed the fir against one of their employees for losing the file and gave me a copy. They also showed me the court proceeding documents against this case. I used these documents to get a ctc of a and b lease as well as previous owner's registry. Now, i want to sell my property but i am told i will lose money. How much less is my property if any. Please advice..

Sir there is a great chance that u can lose some amount in this deal because of the negligence of hbl…their services are getting poor and poor day by day…u should treat them with iron hand so that ur problem can be solved…first of all many people will not be intersted in ur property after hearing all this and those who aill buy it,they will offer u less money.so it is necessary to treat the bank with iron hand and also tell them that if they will be unable to recover your documents,u will sue them…

Thanks for the reply. I can’t do much. These banks are too powerful. If I sue it will take forever to resolve. My lawyer says since I have most recent documents as original it should not matter much in selling the property. How much do you think I can lose? The market with a similar house is 4.75 crores. Also, I still have original registry, mutations etc. Please reply…

Zahid there's no reason for you settle for less. Do you know who the guarantor is in this matter? get the info and also try and get this 'lost papers' thing in writing from the bank.

This is a very simple legal matter and must not be let slipped. You can end up being better off here.

Dear Harris bhai, I already have it in writing from the bank and original FIR they filed so it is clear they lost it. However, everyone tells me my property will be impossible to sell as a result of this. That does not seem fair. I can understand few lakhs less I think. I do have CTC of missing documents. I am just trying to get advice from experienced brothers like you. Jazak Allah..

Sir try ur best to deal those people with iron hand…and u should consult some famous and experienced legal expert in this matter as this is the matter of life time asset and u cannot pay for the mistakes of the banks and its employees…also try to approach media so that this matter can be addressed effectively…simply fir is not the solution of this matter…ask them to pay our loss and also try to take ceo in confidence…simply sue them…its the only solution…

Try to get copy of these documents and their confirmation from the society from where u purchase this property initially.

Saad sb I already did that. I have all ctc if list docs. Like I said not all are lost. I am trying to figure out the loss. Can some tell me how would this impact the price if house valued at 4.75 crore? 5 lakh 10 lakh? Then I can decide if it is worth fighting with the bank. I need to sell.

Sir property agent can tell u about the exact loss who deals in that area…

Mr Zahid, under a normal financial lease contract the gaurantor (couldd be the insurance company or some other financial institution) is liable to guarantee that the contract is fulfilled as agreed (signed). Once it is clear that it hasn't happened the guarantor liable to plug the gap - in this case whatever the lost value is.

I'm not an expert on this neither you might find any, around here (this needs to consulted with lawyers not property guys), but I just read some law based articles regarding this issue. A lawyer like malik wheed anjum or the likes would be your most suited option - although this would be best suited if the insurance company or bank is not willing to pay up.

That's all I have (along with prayers) to say on this. You don't need to suffer any loss whatsoever.

Zahid get it written from the bank that they lost your original documents.

Leases do not prove fruitful in any way at all, neither religiously nor financially. So, i suggest and prefer not to enter into any lease agreement with the banks.
