I made a purchase agreement on july 5th , 2016 for purchasing a banglow in karachi (in cantonment area). As per agreement the seller was bound to provide noc from local authorities and since that banglow fall under the cantonment area then the seller was bound to provide ndc (no demand certificate) from cantonment board/ authorities.
But seller is arguing that there is no such type of requirement for sale deeds. It is almost 3 months and 15 days passed. The agreement was for 2 months.This property is buying on 50% bank loan and 50% self payment. I already prepared the pay order for the payment which i have to pay but hold it.
In the above situation what would be the best legal action. Should i go for renunciation of agreement or wait .
If i opt for cancellation of agreement then how should i initiate the legal proceeding. How much amount i supposed to recover from seller and how many days does it take to recover the advance amount with all expenses.
Going into the court could be a very lengthy and expensive option. Your case would also depend upon the strength of the legal text your agreement signed with the seller.
It is advisable to find an amicable solution out of court, if possible.
