Dear sir,
I want to know if a man say abc dies -before the distribution of property by his father - leaving one widow and one daughter only. The widow marries the younger brother of the deceased and property is still not distributed.
Now after 15 years , the grandfather dies , how the share of abc would be distributed to his widow and his only daughter , keep remember that widow is no more widow and has married her daughter's uncle.
Please share the article of the law also if possible.
Regards
Ali
Dear Ali,
Consult this matter with any inheritance Law expert,as per my knowledge Widow also has the right.
Thanks Sir
Under Muslim Family law Ordinance 1961, grand children have no shares in their grandfather’s estate. So this daughter that you are talking about will not get anything on her grandfather’s death. The only way she can get anything is if her mother gets something. So if the uncle dies and then the mother dies, only then will she get anything in the jaiydaad.
