I recently talked to meezan bank about financing options. They say they do not allow bahria town financing because registry is not your name. Can somebody explain this? Do all bank have same policy?
Danish that is true for all banks. I know because I am a banker myself. No Bank will finance your construction or purchase of property in any Bahria Town, be it Islamabad/Pindi, Lahore or Karachi, because the ownership of land, strictly in legal terms remains with Bahria.
It may be a negative point for new prospective buyers but on the contrary, its a big Positive (land ownership) for those who are already living there.
Thanks Raza sab, Sorry I do not understand the positive side. Its seems very scary if company gets bankrupted or something. What is consumer protection? What will be the status of residents say after 50 years.
There are two main positives. Firstly because of this factor, Bahria can enforce discipline in its societies. For example the use of residential property for commercial offices is a big nuisance in CDA, but no one can do that in Bahria because if bahria cancels their allotment, they cannot even approach a court.
Secondly, if you buy a property for giving on rent, No one can dare do qabza on that because the property belongs to Bahria and they have complete record of who is the real owner. Doing qabza on anyone's property is like doing it on Bahria's property, and I doubt many ppl have the *alls for taking them on. I know of at least one case where ppl were thrown out by Bahria in less than 2 hours after a complaint.
Its good that ownership is not on name of buyers otherwise bahria town will become like Scheme 3 of rawalpindi (make-up and beauty salon ).Even if u look at ISB people have opened schools , clinic at their private homes .
As raza said , one can not take loan for construction or purchasing at BT. They cant snatch property from you .It is transfered on your name and bahria deals with it as Org.

Good answer Raza. But are you sure that Bahria can throw someone out? As far as I know, there is " illegal dispossession Act" promulgated in Musharraf era. I guess it also applies on Bahria even if Bahria is owner of every house.
Does any one else knows about tenant's situation in Bahria? If agreement ends and tenant never vacates, does Bahria do some action on it.

@Danish. May be you should send an email/ letter to the chairman explaining your problem and make a suggestion that Bahria should introduce a home financing scheme for its members. Its not like they are short of funds, if many ppl make that suggestion who knows they might actually do something about it, maybe make a bilateral arrangement with some bank.
@B.R. Malik. I don't know much about law but as I understand, the implication of what you are saying is that someone approaches the police to file a case against them. I mean seriously?!! Well guess who controls the police, and for that matter every other govt dept that you can think of, and who has the resources to hire the best lawyers in the country?! Even if someone succeeds in filing a case, he should be prepared to get arrested himself for having committed a whole range of serious crimes!
As unfortunate as it may sound, that is how the law works around here. So my advice to any such individual would be to settle for a "graceful kick-out". :D

I know someone who failed to pay their house installments in safari villas. Bahria canceled their allotment and asked to vacate the house but they went into a legal battle and filed a case in civil court against BT and Ali Riaz Malik.
Court issued them a stay order which they showed to Bahria management when they came to cutt off their electricity and water supply and BT guy said "Dekh lain gay ham court ko"
after suply cuts they issued a warning to vacate house in 3 days otherwise we will throw you out
they went to court again and court issued a contempt later to ali Malik but they kept threatening the resident finally at third day that poor guy strike the deal with bahria and agreed the pay his remaining amount in 1 month :D
