Daughter Share

My maternal grand father left a house in which my mother had a share along with her siblings now my mother passed away leaving me and my father what will be the share of my father and me as an only daughter of my parents in my deceased mothers share of property?

If your maternal grandfather died before your mother, then your mother inherited her share before her own death. In this case, your father will get one fourth of your mother's estate (property), and the rest will be divided among her children and other heirs.

But if your mother died before her father, then neither you nor your father will get anything.

As for your question, Inheritance Laws have been discussed in detail several time on the forum but I understand how they can still be very confusing.

In your particular situation, your mother should have inherited 1/2 of what her brothers got.

In case of your deceased mother, you will only inherit 1/2 of her share whereas your father gets 1/6th and the remainder goes to your maamoo i.e. your paternal uncle(s).

Sir the husband of the deceased woman will get 1/4th if she has one or more children. If no children, he will get 1/2.

In this case, Ms Sarah is a child that the deceased woman has so the husband will get 1/4.

The rest will be divided between other heirs as per their shares in Islamic Law. If there are no other heirs such as brothers, sisters or mother of the decased woman then Ms Sarah will get 3/4. Otherwise the others will also get their shares.
