Update (November 3, 2019): The Islamabad High Court has issued a contempt of court notice to Captial Development Authority (CDA) Chairman Amer Ali Ahmed. As per news reports, the authority was supposed to issue allotment letters to landowners in C-14; instead, the CDA announced the balloting for plots in the sector.
The Capital Development Authority (CDA) has announced the balloting date for Sector C-14 in Islamabad. Those landowners who had given their land to the authority, as per land-sharing rules, will finally get the possession of their land. The balloting for Sector C-14 in Islamabad will take place on November 12, 2019. Where will it take place? What are the timings? What to expect from the ballot? Balloting for Sector C-14 in Islamabad: Venue and Timings
In a notice, the CDA announced, “subject to the fulfilment of codal formalities for the rules of Land Acquisition and Rehabilitation Policy, 2007 (Land Sharing Basis) and handing over the possession of land of entire Sector C-14, at Mouza Sarai Kharbouza by the affectees/land owners [sic] to CDA,” the authority will hold a ballot for C-14 at 10 AM at CDA Secretariat in Islamabad. The decision came in light of the order issued by the Islamabad High Court (IHC) on Oct. 4.

Development of CDA’s C-14, Islamabad
In order to further develop CDA’s stalled sectors, the authority had earlier decided that it will not acquire more land to launch new sectors. The list of stalled sectors includes C-14, C-13, D-13, C-15, C-16, I-17, F-13, H-16, E-13, I-11, I-14, I-12, I-15, Park Enclave II, Kurri Model Village and the Chatha Bakhtawar Housing Scheme. The sector C-14 is on a land sharing basis. What does this imply? Let us look at it further.
What is land-sharing?
Land-sharing involves landowners of undeveloped plots giving their land to the CDA, which then develops the site. Later, the CDA hands over fully-developed land to the original owners. For Sector C-14, the CDA acquired 4 kanals of land from local landowners and, as per the rules, was supposed to hand over one kanal of developed land.
Due to the delay in post-award activities of C-14, since 2008, land possession and its development couldn’t be possible. This resulted in the infringement of the rights of landowners who participated in CDA’s land sharing award. Now, the authority has shared its plans to develop the stalled sectors of Islamabad, including sector C-14. As per the latest updates on C-14, the sector will be situated on the Margalla Avenue, near Margalla Hills. Parts of Margalla National Park will also be included in C-14. To develop the sector, roads and a commercial markaz will be constructed.
What are the Islamabad High Court’s Orders in this regard?
On Oct. 4, the Islamabad High Court directed the CDA to issue allotment letters to the landowners. Later, on Oct. 19, the high court discouraged ‘compulsory acquisition,’ stating it benefited only a few people. The court mentioned that the procedures involved in the compulsory acquisition should be legitimate and fair on all grounds. As per the court’s orders, “every affectee has to be generously and timely compensated.”
The IHC also maintained the ban on CDA and Federal Government Employees Housing Foundation (FGEHF) on the allotment of plots, except for auctioning, till January next year. The court also took notice of the fact that many landowners of C-14 who had given their land to the authority have passed away and their heirs are now making efforts to get possession of their land.
